KULIM, November 7, 2026 — Home Minister Datuk Seri Saifuddin Nasution Ismail said the best interpretation of the legal differences over Datuk Seri Najib Razak’s house arrest should be made in court, adding that his ministry is bound by the Attorney General’s advice.
Speaking to reporters at the closing of the four-day Semarak Kebudayaan Masyarakat Kedah Bersama PDRM Kedah programme at the Kulim Hi-Tech Park Sports Complex, Saifuddin said the position of the Home Ministry, including the Prisons Department, was “very simple” and “clear”.
Saifuddin said Najib was entitled to seek the pardon, and that under the Federal Constitution the power is the power of the Yang di-Pertuan Agong.
Saifuddin said the ministry’s part is to implement it in line with the framework and order of the law.
Referred to Attorney General
Saifuddin said that after the payment was made yesterday, the ministry referred the matter to the Attorney General, because the order of discharge issued by the court registrar created a somewhat different legal interpretation.
He said the ministry sought the Attorney General’s view so there would be clarity, and that it is bound by the legal advice of the Attorney General as the government’s legal adviser.
Saifuddin said the ministry had done everything at its level to implement any decision, whether at the Pardons Board level or a court order.
Saifuddin said the Attorney General had given a legal view and Najib’s lawyers had responded.
Saifuddin said where there are such differences, as the Attorney General advised, the best interpretation should be made in court.
AGC position
The RM50 million fine was paid on November 6, 2026. In a media statement on November 7, the Attorney General’s Chambers (AGC) said it is not disputing, setting aside or seeking to suspend the Conditional Pardon Order and that the legal effect of the 6 November 2026 Order of Discharge on the remaining SRC International sentence should be referred immediately to the court.
